Living by Design warranty covers the replacement or repair of any good supplied by Living by Design that has a defect. It does not include defects that arise as the result of normal wear + tear, or which are a natural characteristic of the material used to produce the good. Unless stated otherwise, this warranty is not transferable and does not cover products used for commercial purposes.
FURNITURE WARRANTY PERIOD :
Fully Upholstered Sofa + Armchairs:
Structure & frame : 3 Years Limited Warranty
Soft furnishings - Foam, fibre fillings, feathers, fabric covers, stitching, leather: 1 Year Limited Warranty
Armchairs — Timber frames with leather or rattan:
Structure & frame : 2 Years Limited Warranty
Soft furnishings - Rattan, stitching, leather: 1 Year Limited Warranty
Occasional Furniture including Buffets, Hall tables, Coffee tables, Bedroom furniture + Side tables: 1 Year Limited Warranty
Beds + Bed heads + Ottomans : Structure & frame: 2 Years Limited Warranty
Soft furnishings: Foam, fibre fillings, feathers, fabric covers, stitching, leather: 1 Year Limited Warranty
Dining Tables + Chairs + Stools : Structure & frame: 2 Years Limited Warranty
Soft furnishings : Foam, fibre fillings, fabric covers, stitching, leather: 1 Year Limited Warranty
Aria Concrete Collection: 1 Year Limited Warranty
Marble furniture : 1 Year Limited Warranty
Outdoor : 1 Year Limited Warranty
Rugs + runners : 1 Year Limited Warranty
CONSUMER GUARANTEES :
1. You are entitled to a replacement or refund for a major failure of the good and, in some cases, for compensation for any other reasonably foreseeable loss or damage.
2. You are entitled to have the good repaired or, in some cases, replaced if the good fails to be of acceptable quality and the failure does not amount to major failure.
EXCLUSIONS :
This Warranty does not apply to any good that has been sold as seconds, floorstock, goods that are repaired, or goods that have a defect where this has been drawn to your attention before the purchase of the good. Further exclusions from this Warranty apply in relation to:
[1] Normal wear & tear. The following may occur as a result of natural and normal usage; leathers and fabrics will fade and crease; foam and fillings will soften and form variable shapes over time: depending on the covering and the degree of use, cushion fillings may need to be replaced periodically at the purchaser’s expense
[2] Goods have been repaired by a 3rd party or installation/assembly or transportation carried out by a 3rd party
[3] Furniture have not been used or maintained in accordance with Living by Design care instructions;
[4] Items has been used in an abnormal manner or subject to extreme use including where products that have been stored or assembled incorrectly, the good is misused, exposed to extreme heat or cold, not maintained properly, exposure to direct sunlight
[5] If a good is relocated from its original delivery location.
[6] All outdoor furniture, including teak + woven + powder-coated + resin products, are recommended for undercover outdoor usage only. We do not recommend outdoor furniture to be exposed to the elements under any circumstances for a prolonged period. If the products are used for exposed outdoor usage, this does void any warranty.
[7] If a good is used for commercial purposes.
REPAIR AND REPLACEMENT :
Living by Design reserves its rights to: [a] request photos and/or videos to assess any warranty claims; (b) exercise discretion to determine whether an item will be replaced and, in so doing, will take into account if the request is seen as unreasonable.
Living by Design may require the return of the good(s) in relation to which warranty is claimed before Living by Design provides the refund or replacement.
Where we determine, at Living by Design's discretion, that the most appropriate remedy is to repair the goods, we will endeavour to do so within a reasonable time.
You must retain your proof of purchase for any warranty claims.
PRODUCT VARIATIONS :
Living by Design's furniture ranges have natural characteristics and are sometimes produced with raw or untreated finishes.
Goods with a rustic or organic nature are all unique & individual, & hence the product may vary from online images or display models.
Due to lighting conditions and natural materials, product colours may seem different from the imagery. If an item has only a minor variation from the imagery or display models in colour, shade, texture, then the item is taken to correspond to the imagery and display models. Such minor variations are not taken to be manufacturers’ defects for the purpose of this Warranty.
LIMITATION OF LIABILITY :
Living by Design’s liability shall be limited to, as we determine;
[a] The replacement of the goods or the supply of equivalent goods
[b] The payment of the cost of replacing the goods or of acquiring equivalent goods
CLAIM PROCEDURE :
To make a warranty claim pursuant to this Warranty, please follow the below procedure:
Step 1: Cease using the good immediately after the defect appears
Step 2: Contact Living by Design via Email info@livingbydesign.net.au or by Phone 08 8399 1250
Step 3: Send all relevant information as may be requested by Living by Design via email, for initial assessment
Step 4: Living by Design will assess the goods, & decide whether the goods need to be returned to Living by Design’s warehouse for further inspection or repair. Note that all costs associated with returning the good(s) must be borne by you (which would include any freight and insurance charges).
Step 5: If we determine there is a valid claim pursuant to this Warranty, Living by Design will reimburse you for any reasonable transportation costs paid by you.
